Chinese Airlines Challenge New European Emissions Law

The European Union's new regulations on carbon emissions for airplanes is set to go into effect in January. After a round of negotiations in Beijing, members of the Chinese airline industry are threatening to sue over the new rules.

As of January 2012, the European Union will implement a new Emission Trading Scheme, or ETS, that will see stricter rules on carbon emissions. Airlines will be struck with sizeable new obligations, as they will have to buy permits for their emissions.

Although the early stages of the plan will see 85% of emissions permits given free to airlines, and costs only on the remaining 15%, some foreign air businesses are concerned. The Chinese air industry has issued especially strong protests.

The China Air Transport Association along with representatives of four Chinese airlines held a new round of negotiations with EU officials on carbon emissions in Beijing this week.

Some Chinese air industry officials have said that their airlines are intending to sue the EU over the carbon emission issue--though on what grounds remains to be seen. For now, the question of whether airlines will comply with the new rules, or take retaliatory measures, remains up in the air.
