Bellevue Divorce Discovery Process - Gathering Legal Information for Your Bellevue Divorce

The legal discovery process begins after your Bellevue Divorce case has been filed. Because, once the case is filed, and we’ve talked about this in some of our other sessions, the court takes jurisdiction over your financial and personal situation. So, once you file a case, then you can use various legal tools to gather information. And the first legal tool you will probably use in Interrogatories. I've mentioned them before.

Interrogatories are written questions that you send to the other side, or that they send to you that are designed to cover every eventuality. The Interrogatories have a time period in which you must comply, and they must be answered under oath. You have to sign a statement at the end - “I declare under penalty of perjury of the state of Washington that the foregoing answers are true and correct.” - and then they may even be notarized.

So the point I’m making is that if you’re answering interrogatories about your Bellevue Divorce, it’s extremely important that you answer them honestly and fully to the best of your ability.

The other thing that happens during the interrogatories is called a request for production. In other words, you are going to have to furnish proof that back up your answers. If you say you have so much money in a savings account, you are going to have to produce the details of that account and up to 5 years of your latest bank statements. The same holds true with your credit card records, phone records, mortgage payment records, etc. Get ready to produce a lot of copies.

If for some reason, you cannot get answers to the interrogatories you asked of your spouse, and they won't produce the records you or your Bellevue Divorce Attorney have requested, the next step would be issuing an actual subpoena.

The whole purpose of all of this is simply legal discovery. Getting to the bottom of the financial situations of the parties so the courts have the information they need to make a final divorce decision.
