It is pointless to argue with them or to threaten them whether they are your company or the wrongdoer’s company. They are not intimated by you, by your threats or even by your attorney. They view it as their “cost of doing business” and is nothing more than a calculated business decision. Your insurance company must provide the coverage it promises in your auto insurance policy. If it does not, you may sue for breach of contract and insurance bad faith. Your own insurance company has what’s known as a “fiduciary” obligation to you the insured. They have a higher level of responsibility to your than the wrongdoer’s insurance company. In many cases, just hiring a lawyer is enough to show the insurance company, whether yours or not, that you are willing to protect your rights.
