New Jersey FLSA Attorney Deborah Mains explains FLSA lawsuits and how employees can recover unpaid overtime in New Jersey. The Fair Labor Standards Act (FLSA) is a federal wage and hour law that governs overtime pay in New Jersey. If a New Jersey employer fails to pay overtime to a non-exempt employee, he or she has the right to file an FLSA lawsuit against the employer to recover wages and further damages. If the employee's FLSA lawsuit prevails, the FLSA also will cover attorney fees associated with the case, so they employee does not have pay these fees.
