The warning comes as the U.S. Court of Appeals for the Federal Circuit weighs whether to uphold or overturn a May decision striking down most of Trump’s tariffs. Sauer and Shumate said the administration would pursue a new tariff program if the current one is voided, but argued it would be less effective.
