A federal judge in Florida dismissed the criminal case against Donald Trump for retaining classified documents after leaving the White House, saying the appointment of special counsel Jack Smith to lead the prosecution was unconstitutional. Special Counsel Jack Smith plans to appeal the decision to the 11th Circuit Court of Appeals. Judge Aileen Cannon, who was appointed by Trump, said the Special Counsel position violates the Appointments Clause of the US Constitution. Dismissing the case effectively ends the criminal prosecution against Trump in Florida unless an appeals court overrules the decision. Trump still faces another criminal case in Washington, D.C., over trying to overturn the 2020 election results.
