The US Patent and Trademark Office has maintained that AI systems cannot be named as inventors on patents. The USPTO confirmed that humans can use AI tools in the invention process and must disclose any AI use when applying for a patent. To qualify as an inventor, a person using AI must have contributed significantly to the invention's conception, not just asking the AI to create something. Simply overseeing or owning an AI system that creates things does not mean a person can file for the resulting patents.
