I'm Indiana personal injury attorney David Holub.
I would guess that many of you have had tire tread fly off a semi-tractor trailer truck ahead of you on the road. Or witnessed the remnants of tire tread lying in the roadway or along the shoulder of the highway.
When tire pieces fly off, they can smash a windshield and cause a driver to lose control. When this happens, the semi often does not stop.
There are, of course, trucking industry regulations that require a vehicle's tires to be inspected each day before the driver climbs into the cab and pulls out onto the highway. Brakes are also to be checked daily, and the lights on the vehicle are to be examined.
Even though a truck may leave the scene, an effort can be made to identify the truck.
Getting a license plate (or even a partial plate) may allow vehicle identification. Once the vehicle is identified, you can pin down a particular vehicle's location on the highway by checking GPS records.
Even if you cannot get a license plate, if a truck displays a logo, you may be able to identify the trucking company.
With this information, the suspect company can be sued and asked to verify whether any of its trucks were in the vicinity of the crash at the date and time it happened. If so, did any of the company's truckers report a loss of tires?
