Justice Arun Mishra, chairman of the National Human Rights Commission, has said that it would be wrong to form a general opinion that the implementation of AFSPA in many northeastern states violates human rights. It cannot examine or debate the legality or constitutionality of the Act. The need to implement or withdraw the Act will be reviewed by the Government.But Justice Mishra emphasized in this conversation that the National Human Rights Commission takes custodial death or extra-judicial killings very seriously. He said that in such cases the commission can take suo motu cognizance. Justice Mishra said that the commission takes the merits of the cases. - Considers the blame and announces compensation for the family members of the victims and the state governments comply with it.

राष्ट्रीय मानवाधिकार आयोग के अध्यक्ष जस्टिस अरुण मिश्रा ने कहा है कि यह आम राय बनाना गलत होगा कि कई पूर्वोत्तर राज्यों में आफस्पा लागू करने से मानवाधिकारों का उल्लंघन होता है.आयोग के अध्यक्ष जस्टिस अरुण मिश्रा ने कहा है कि आयोग सशस्त्र बल विशेषाधिकार अधिनियम यानी आफ़स्पा की वैधता या संवैधानिकता की पड़ताल नहीं कर सकता या इस पर बहस नहीं कर सकता.अधिनियम लागू करने या इसे वापस लेने की आवश्यकता की समीक्षा सरकार ही करेगी.लेकिन जस्टिस मिश्रा ने इस बातचीत में जोर दिया कि राष्ट्रीय मानवाधिकार आयोग हिरासत में मौत या न्यायेतर हत्याओं को बड़ी गंभीरता से लेता है.उन्होने कहा कि ऐसी मामलों में आयोग स्वत: ही संज्ञान ले सकता है.जस्टिस मिश्रा ने कहा कि आयोग मामलों के गुण-दोष पर विचार करता है और पीड़ितों के परिवार के सदस्यों के लिए मुआवजे की घोषणा करता है और राज्य सरकारें इसकी पालना करती हैं.
