MANILA - Father Ranhilio Aquino, dean of the San Beda College Graduate School of Law, says while the Supreme Court is clear on the unconstitutionality of the DAP, it is far less clear on who should be held accountable for it. He notes the Court also made a pronouncement on the so-called "prospectivity" of its decision. "This means magmula ngayon, hindi niyo na puede galawin yung mga ginagalaw ninyo noon pero kung may mga nangyari na sa nakaraan at yan ay nagawa in good faith, na wala lang alam na paglabag sa batas ay hindi mo magagamit ang desisyon ng Korte Suprema na basehan upang mapanagot mo sa hukuman sa isang criminal case man o administrative case or civil case man ang isang opisyal," he said in a radio DZMM interview. Father Aquino adds while it is debatable whether the President can be impeached over the controversial program, the bigger issue he faces is if the funds were used to influence the outcome of the impeachment trial of former Chief Justice Renato Corona. "May alegasyon na yung DAP ay ginamit niya upang maimpluwensiyahan niya yung mga senador na magboto sa impeachment court laban kay Chief Justice Corona. Ngayon, yun ang puedeng ikaso sa kanya kasi alam niya man na labag sa Saligang Batas o hindi, maling-mali pa rin na gagamitin mo ang pera na galing sa kaban ng bayan at ng impluwensiyahan ang paglalabas ng isang opisyal," he said.
