Today is a big day in the case of Kulbhushan Jadhav who was arrested by Pakistan and then subsequently sentenced to death by a military court in Pakistan on charges of being a spy. India which maintains that Kulbhushan Jadhav was not a spy has now taken recourse to legal remedies and will be arguing about his wrongful arrest and unfair trial by a military court in Pakistan.

India, which is hopeful of getting the International Court of Justice (ICJ) to rule in its favour will be invoking section 5 and 36 of the Geneva convention along with clauses 2, 3 and 4 of the India-Pakistan agreement which clearly spells out the right for consular access for a country in case one of its citizens is arrested.

In the past the ICJ has ruled in favour of nations which have sought consular access like in the case of USA vs Germany in 1998 and USA vs Mexico in 2003.

Pakistan has denied consular access to Kulbhushan Jadhav for a record 16 times, and India is hopeful that the International Court of Justice would give a verdict in favour of India.
