Third day of hearing on the constitutional validity of section 377 of the IPC. Yesterday the Supreme Court said that the matter in court is restricted to whether homosexuality should be treated as a crime or not. The apex courts' observation came after the centre filed a 3-page affidavit in the court. The bench hearing the case said that choice of partner comes under article 21 which makes it a fundamental right and consensual sex between two adults cannot be treated as an offence even when it is unnatural. Now that the centre has left the matter to the wisdom of the court, can we say that a 158-year-old colonial law will finally be scrapped?
