LEVITTOWN, PENNSYLVANIA — An unidentified customer who shot and killed an armed robber at a pizza takeout store in Pennsylvania on Tuesday will not face charges.

Police said the man had a concealed-carry license, and even though his permit had recently expired, he would not be charged, ABC-affiliate WPVI reported.

The man, who was the last customer of the night, was waiting for his order at Porfirio’s Pizza and Pasta II in Levittown, when two masked men burst through the doors.

Brandishing weapons that were later found to be pellet guns, the robbers pistol-whipped the customer, striking him in the head. But when suspect Shawn Rose turned away, the customer pulled out a handgun and shot the 24-year-old stickup merchant dead.

The customer then turned his attention to Rose’s 22-year-old brother and would-be partner in crime, Justin, and fired two shots.

Justin Rose was blasted through the pizza shop’s front door. He was later transferred to the hospital where he was reported to be in critical condition.

The customer refused treatment for cuts to his head sustained when he was pistol-whipped. The owners of the pizza shop hailed him a hero.
