AIKEN, SOUTH CAROLINA — Two South Carolina residents are suing the Aiken police department and the City of Aiken in federal court over an illegal cavity search in 2014.
Lakeye Hicks was driving her newly-purchased car with her boyfriend Elijah Ponton near downtown Aiken in October 2014 when they were pulled over by officer Chris Medlin and his fellow officers.
Medlin ordered the pair to step out of the car and handcuffed Pontoon even though both of their identifications checked out. In fact, South Carolina does not have any law that requires the passenger of a vehicle to provide identification to officers.
Officers then thoroughly searched the car as well as instructing a dog to sniff the car but they were not able to find any contraband.
The officers then conducted body searches on the couple. Hicks allegedly received a breast check that involved exposing her breasts on the side of the road and was in direct view of the male officers.
Pontoon was handcuffed and forced to receive an anal probe during which two officers allegedly inserted their fingers into his rectum to search for something hard, which Pontoon said was his hemorrhoid.
The couple was let go with a warning after the officers failed to find anything contraband from the car or their bodies.
A trial date for the case has not been set yet.
"The City of Aiken denies the Plaintiffs' allegations and is vigorously defending this lawsuit. We will have no further comment about the facts of this case during the pendency of this litigation," David Turno said on behalf of the Public Safety department of Aiken said in an email to the Aiken Standard.
