NYPD shoots hammer attack suspect near Penn Station

A madman who assaulted three women and a man in Manhattan with a hammer was shot twice in Midtown Wednesday after violently swinging the tool at a female cop, police said.

The gunfire erupted at the busy intersection of W. 37th St. and Eighth Ave. about 10 a.m. after two cops saw him and thought he might be the hammer-attack suspect whose photo was released a day earlier.

NYPD Chief of Manhattan Detectives William Aubry said Officers Geraldo Casaigne, 36, and Lauren O'Rourke, followed the suspect, but he turned around and started swinging the hammer. Casaigne, an Iraq War vet, fired four rounds to protect his partner, cops said.

"When he turned around he pulled out the hammer and violently started swinging the hammer at the female officer," Aubry said.

"As he's swinging the female officer is back-tracking into the middle of 37th and Eighth," he said. "Her partner, the male officer, sees her struggling and he fires his weapon four times at this individual, striking him twice."

The suspect, identified as David Baril, 30, was shot one time in the shoulder and one time in the back, cops said. He was taken to Bellevue Hospital in critical condition.

Police said O'Roarke was hit in the head with the hammer three times during the brutal attack.

Police said they have video of the confrontation.

Baril has had psychological problems in the past and appears to have written dark poetry on a social media site, Vocativ.com first reported.

"I brought a gun to this fight time to die ..." a poem titled "Blood Stain" and posted on Instagram in 2014 reads.

Baril also has a long list of priors and was wanted on a warrant for a March 21 assault at a Kentucky Fried Chicken in the Bronx, records show.

He placed an order at the fast food restaurant in Kingsbridge and yelled at the cashier to give him his change.

"Where is my $10? Give me my f****** change," he demanded, according to a criminal complaint.

As the cashier turned away, he punched her in the back. He was charged with misdemeanor assault, menacing and harassment.

A bench warrant was issued on April 22 after Baril failed to show up for a scheduled court appearance.

He's also been in trouble for attacking a cop before, police sources said.
