1) What Does A Notary Public Do?

Notary Publics are officials appointed by the State of California to witness/verify the signing of many different types of important documents, and to administer oaths/affirmations (for sworn statements, affidavits, declarations of fact, etc.) Many documents are not legally binding without the involvement of a Notary Public.

The primary purpose of the Notary Public is to deter fraud by verifying the identity of document signers; and to help ensure the signers are executing the document knowingly and willingly. Notaries essentially notarize signatures, not documents.

Notaries may also take Depositions.

2) Identification Requirements

California Notary Law is very specific about which forms of ID are acceptable to complete the notary process. Generally, the ID you provide must show your physical description, your photo and your signature. The Notary Public will carefully check your ID with the latest anti-fraud techniques such as UV Lighting, Physical Feature Examination, ID Reference Guide Comparisons, etc. You may use the following guide to help you choose the proper forms of ID for your meeting with a Notary Public.

Acceptable Forms of ID:

- California Driver's License (or ID card from DMV)
- U.S. or Foreign Passport (must be signed, and stamped by US INS/CIS)
- Valid Mexican/Canadian Driver's License
- Valid ID Cards/Driver's Licenses from other U.S. States.
- Older Military ID Cards if the physical description/signature are visible.
- Inmate ID Card from CA Dept. of Corrections if inmate is still in custody.
- ID Card issued by State of CA public agencies (City/County/State).

Unacceptable Forms of ID:

- Mexican Matricula Consular Cards
- Newer Military ID Card (no signature/physical description)
- Birth Certificate
- Marriage License
- International/Foreign Driver's License (except Mexico & Canada)
- Social Security Card
- Baptism Certificate
- Credit Cards

3) Notary Public Fees

Notary Publics usually charge a notarization fee of $10 per signature (that is the legal limit in California for most Notary Acts). In addition to the $10 notary fee, they will also charge an additional fee to cover whatever necessary expenses they incur in order to operate a successful business as a Mobile Notary Public. The additional fees help them cover their time, travel expenses, insurance, required bonding, necessary materials, etc. Total fees can vary widely from no charge at all to hundreds of dollars for certain types of specialized notary work.
